On October 28, 2026,  the Department of Homeland Security (DHS) announced the addition of three Chinese companies to the Uyghur Forced Labor Prevention Act (UFLPA) Entity List. Effective October 29, 2026, U.S. Customs and Border Protection (CBP) will apply a rebuttable presumption that goods produced in whole or part by these three companies are made with forced labor and prohibited from entering the United States.

According to a press release by DHS, the three Chinese genomics companies help the government of the Xinjiang Uyghur Autonomous Region build and operate its mass surveillance infrastructure.  The three entities added to the UFLPA Entity List are related companies – Shenzhen BGI Technology Co., Ltd. (BGI Group) is the controlling shareholder of BGI Genomics Co., Ltd.  MGI Tech Co., Ltd. is under the control of the same ultimate controlling shareholder as BGI Group.

DHS has issued an updated UFLPA Entity List.  For general background information on the Uyghur Forced Labor Prevention Act (UFLPA), see Thompson Hine’s International Trade Update of June 2022. In addition, CBP’s UFLPA Dashboard containing current statistics and is available here.
