On April 6, 2026, Senior Judge Richard Eaton of the U.S. Court of International Trade (CIT) granted the Notice of Dismissal filed by counsel for Atmus Filtration, Inc. in Atmus Filtration Inc. vs. United States, the lead case seeking refunds of tariffs paid under the International Emergency Economic Powers Act (IEEPA). Subsequently, he issued an order in Euro-Notions Florida, Inc. v. U.S. Customs and Border Protection, et al. (Court No. 25-00595), another case which challenges the imposition of IEEPA tariffs, that lifts its stay in a move designed to replace Atmus Filtration with Euro-Notions Florida. On April 7, 2026, in Euro-Notions Florida, Judge Eaton issued an order mirroring what had been in place in Atmus Filtration, stating that:
with respect to any and all unliquidated entries that were entered subject to IEEPA duties, U.S. Customs and Border Protection [CBP] is hereby directed to liquidate those entries without regard to the IEEPA duties. Any liquidated entries for which liquidation is not final shall be reliquidated without regard to those duties. Any liquidated entries for which liquidation is final shall be reliquidated without regard to the IEEPA duties.
The U.S. Department of Justice entered an appearance on behalf of the federal government defendants in Euro-Notions Florida. At the time of this blog post, no other orders have been issued
